Notification of any key changes to the terms will be sent to subscribers via email or website updates. After modification, your usage of the content or services means you have agreed to the revised terms.

All our paid services are subscribed according to the service period. When signing up for a paid service, you can choose relevant terms of service and payment options. By default, your subcriptions will automatically renew, and the amount of payment will be charged at the end of each service period, unless you decide to cancel the auto renewal for the service before the end of the current subscription. All prices (including fixed subscription fees) are subject to change. You will be notified of any changes in rates in advance. All fees exclude tax. However, we may calculate and add any taxes and/or other fees, including but not limited to business tax, value-added tax and other taxes and fees applicable to your laws. Such taxes and fees will be calculated based on the billing information provided to Touch VPN at the time of purchase.

If you want a refund, you can request it within 30 days after purchasing the service. Your satisfaction is very important to us. However, we want to troubleshoot the problem you encountered first. There might be some common service configuration problems that may prevent you from using the service, and we will help most users solving the problems they have. Normally Refunds will be processed within seven (7) days and paid in the payment method used at the time of purchase.

Subscriptions purchased through iTunes / App Store are subject to the iTunes / App Store refund policy. Tthat means if you purchased the App through iTunes / App Store, we will not issue a refund, and you must contact store support for this. Payments made with prepaid cards or gift cards will not be refunded.

You have the right to cancel your account at any time. You can also cancel fixed subscriptions from Touch VPN, iTunes, App Store or Google Play Store. The cancelled account will not be refunded for the unused portion of the ongoing service.

For accounts terminated due to violation of these terms, refunds will not be considered.

By using our services, you must not:

• Use, assist, encourage or allow others to use the service for any illegal, criminal or fraudulent activities, including but not limited to port scanning, sending spam, sending opt-in emails, scanning for open relays or open proxy, and sending emails without requested or any version or type of email sent in bulk, even if the email is routed through a third-party server. Any pop-up window activation, usage of stolen credit card, credit card fraud, financial fraud, cryptocurrency fraud, disguise,

• blackmail, kidnapping, rape, murder, selling stolen credit card and goods, offering or selling prohibited goods, providing or selling the controlled substances, identity theft, hacking, generic drugs, phishing, capturing digital piracy and other similar activities in any form or scale;

• Attack, interfere, gain unauthorized access or reject other network, computer and service points through our services in any form. Exploit children in any way, including audio, video, photography, digital content, etc.;

• Infringe or misappropriate the other’ intellectual property, privacy or other legal rights;

• Share any illegal, insulting, harassing or other offensive content;

• Spread any viruses or other computer instructions or technical means that destroy, damage or interfere with computers or related systems;

• Try to circumvent any technical measures implemented by Touch VPN;

• Interfere or destroy the integrity or performance of the service;

• Take any measures that may impose an unreasonable or disproportionately large load on our infrastructure;

• Sublicense, sell, resell, transfer, distribute, conduct commercial development or provide services to any third party in any way;

• Use similar ideas, features, functions or graphics to build products, or copy service ideas, features, functions or graphics;

• Threatening, stalking, hurting or harassing others, or fostering bigotry and discrimination;

• Attempt to access the service, user account, computer system or network through hacking, password mining, brute force attacks or any other means without authorization.

• Use the service for purposes other than legitimate purposes;

• Use the service for any military purpose, including cyber warfare, weapon development, design, manufacture or production of missiles, nuclear, chemical or biological weapons;

• Infringe or circumvent these terms in other ways. You should always comply with all applicable local, state, national and foreign laws, treaties, and regulations related to the service, including those related to data privacy, international communications, and technical or personal data transfer. If you use the service and cause a complaint with Touch VPN, Touch VPN may believe that your action violates these terms and terminate your account without prior notice.

We do not guarantee that this service will be completely free of defects and errors, such as downtime, data loss, data corruption, service delays, errors, outdated information or others. Notwithstanding the provisions of these terms, we reserve the right to change, suspend, delete or disable access to the service or any part of the service without notice at any time. We are not responsible for these changes under any circumstances. As a reputable user, Touch VPN may provide you with limited services. We are not responsible for your use of the service or other products or services we provide. We may also impose restrictions on the use or access to the service for any reason without notice or responsibility. Due to man-made, digital, mechanical, telecommunications, software and other malfunctions, our services may not be available sometimes. We cannot predict or control when such outages will occur, nor can we control the duration of such outages.

For any delay or inability to perform due to unforeseen circumstances or reasons beyond our control, we do not assume any responsibility, including but not limited to the failure of third-party software (whether opened or not), failure of telecommunications or Internet service providers on your part, earthquakes, fires, floods, embargoes, labor disputes, strikes, riots, wars, other unforeseen product development issues, and actions by civil and military authorities etc.

Touch VPN shall not be liable and shall not have responsibility of any kind to any Subscriber or other individual for any loss or damage that you incur in the event of:

• Any failure or interruption of the Site or Service;

• Any act or omission of any Third Party involved in making the Site or Service or the data contained therein available to you;

• Any other cause relating to your access or use, or inability to access or use, any portion of the site or its Content;

• Your interactions on the Site or Service;

• Your failure to comply with this Agreement;

The cost of procurement of substitute goods or services; orunauthorized access to or alteration of your transmissions or data, whether or not the circumstances giving rise to such cause may have been within the control of Touch VPN or of any vendor providing software, services, or support for the Site or Service.

In no event will Touch VPN, its partners, affiliates, subsidiaries, members, officers, or employees be liable for any direct, special, indirect, consequential, or incidental damages, or for any other loss or damages of any kind, even if they have been advised of the possibility thereof. The foregoing shall not apply to the extent prohibited by applicable law.

You agree to indemnify, defend, and hold harmless Touch VPN, its subsidiaries, officers, directors, employees, agents, issuers and licensees, and their respective affiliates and people concerned, from any and all claims and expenses, including attorneys’ fees, arising out of your use of the Content and Service, including but not limited to your violation of this Agreement. The assumption of such defense or control by us, however, shall not excuse any of your indemnity obligations.

Subject to your compliance with these terms, Touch VPN grants to you a non-exclusive and limited license to download and use the Software. Modifying, distributing to unauthorized parties, reverse engineering, or otherwise using the Software in any way not expressly authorized by Touch VPN is strictly prohibited.

It is prohibited to use any material protected by Touch VPN's intellectual property rights, unless Touch VPN has specifically provided you with a written consent.

All our content was originally written in English. We will do our best for the translated version. We cannot guarantee the accuracy of the translated content. If there is a discrepancy between the translated content and the English content, the English content shall prevail.

We reserve the right to modify and update these terms for any reason without any responsibility at any time.
